In these Terms of Service, "we", "us", and "our" refer to Ohrenberg Venture LLC, the operator of this website and related services. "You" refers to the user of our services.

Welcome to our Terms of Service. These terms govern your use of our website and services. By accessing or using our services, you agree to be bound by these terms.

Acceptance of Terms and Eligibility

Before using this service or creating an account, you must read and agree to these Terms of Service. To create an account, you will be required to check a box or click an “I Agree” button, confirming that you accept all terms and conditions. By doing so, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you do not meet these requirements or do not agree to the Terms, you may not access or use our services.

Account and Funds

You may create an account on the Site and add funds for use on the services we offer. All funds you load into your account are treated as prepaid service credits and have no cash value. These credits are non-refundable and non-transferable: once money is added to your account, you cannot exchange it for cash, give it to another user, or recover it for any reason. In particular, if your account is terminated or remains inactive for a period of 12 months, any remaining balance will be forfeited. Funds may only be used to activate eligible machines listed on our Site.

Payment Processing

All payment transactions on the Site are handled by our third-party payment processor. We do not collect or store any credit card or other payment data on our servers. Your payment details are submitted directly to the processor (for example, via PayPal) and are subject to that processor's security and compliance measures. As a result, we do not handle sensitive payment information and are not directly subject to PCI DSS requirements.

Personal Information

During account creation, we collect only the basic personal information needed to set up and manage your account, such as your legal name, mailing address, email address, and telephone number. We use this information solely to administer your account, process payments, internal analytics, and communicate with you about your service. We will not sell or share your personal information with third parties.

Service Availability and Disclaimer

We provide the Site and related services on an “AS IS” basis without any warranty. We do not guarantee that the Site or the physical machines will be available without interruption. Service may be interrupted or suspended for maintenance, outages, or other issues at any time. To the extent permitted by law, we expressly disclaim all warranties (express or implied), including any implied warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

To the maximum extent allowed by law, we are not liable for any damages arising from your use of the Site or our services. We cannot guarantee service uptime and disclaim liability for any interruptions. In no event will our liability (whether in contract, tort, or any other theory) exceed the amount you have paid us in the one month prior to the event giving rise to the claim. We also disclaim any indirect, special, incidental or consequential damages, including loss of profits, data, or use of the equipment or services, even if we have been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold us and our affiliates harmless from any claims, liabilities, damages, and expenses (including attorneys' fees) arising out of your use of the Site or services. This includes any claim related to your account, any content you submit, or any violation of these Terms by you or your account users.

Account Termination

We may suspend or terminate your account at our discretion, including for inactivity or breach of these Terms. Upon any termination, we will refund any remaining balance in your account. Termination does not limit any obligations or liabilities that you or we may have incurred prior to termination.

Governing Law and Dispute Resolution

These Terms will be governed by the laws of the State of MO. Any dispute arising under or relating to these Terms or your use of the Site will be resolved by binding arbitration in accordance with MO law. You and we waive any right to a jury trial or class action lawsuit; any claims will be pursued on an individual basis in arbitration under MO law.
